9.07. Adoption.


          The Council shall adopt the budget by ordinance not later than the 30th day of September. Adoption of
          the budget will require an affirmative vote of at least four of all the members of the Council. Adoption of
          the budget shall constitute appropriations of the amount specified therein as expenditures from the fund
          indicated, and shall constitute a levy of the property tax therein adopted.

          9.08. Defect Shall Not Invalidate Tax Levy.


          Errors or defects in the form or preparation of the budget or the failure to perform any procedural
          requirements shall not nullify the tax levy or the tax rate.




          9.09. Failure to Adopt a Budget.

          If the Council fails to adopt the budget by the 15th day of September the amounts appropriated for the
          current fiscal year shall be deemed adopted for the ensuing fiscal year on a month-to-month basis with all
          items in it pro-rated accordingly until such time as the Council adopts a budget for the ensuing fiscal year.
          The levy of property tax normally approved as a part of the budget adoption will be set to equal the total
          current fiscal year receipts, unless the ensuing fiscal year budget is approved by September 30th of the
          current fiscal year.

          9.10. Public Records.


          Copies of the approved operation budget, capital facilities and property budget and supporting papers
          shall be filed with the City Secretary and shall be public records available to the public upon request.


          9.11. Specified Reserve Fund.


          Specified reserve funds may be created for specific purposes, and may be used only for such purposes.

          B.
          AMENDMENTS AFTER ADOPTION


          9.20. Supplemental Appropriations.


          If during the fiscal year the City Manager certifies that there are revenues available for appropriation in
          excess of those estimated in the budget, the Council may make supplemental appropriations to fund the
          appropriations as desired or carry the excess into the next fiscal year.


          9.21. Emergency Appropriations.


          To meet a public emergency created by a natural disaster or man-made calamity affecting life, health,
          property, or the public peace, the Council may make emergency appropriations. Such appropriations may
          be made by emergency ordinance in accordance with the provisions of 3.14 of this Charter.
          In such case, the Council may by emergency ordinance, authorize the issuance of emergency notes,
          but the emergency notes and renewals shall be paid not later than the last day of the fiscal year next
          succeeding that in which the emergency appropriations were made.
